Health maintenance activities are limited to those activities that, if not for an individual’s disability, he or she could reasonably be expected to perform independently. They are the basic functions that make up ongoing care, such as:

  • Assistance with medications
  • Managing personal hygiene
  • Cleaning a feeding tube
  • Range of motion training
  • Straight catheter care
  • Nebulizer treatment
  • Tube-feeding
  • Colostomy maintenance
  • Transfer assistance
  • Blood glucose monitoring
  • Blood pressure monitoring
  • Administering enemas
  • Oxygen therapy

A proxy caregiver is not expected do to things that are considered complex care, like giving intravenous medications,providing complex wound care, or making complex observations or critical decisions. The proxy caregiver’s tasks can be safely performed and have reasonably precise, unchanging directions; they have outcomes or results that are reasonably predictable.

These activities are typically taught by a registered professional nurse, but may also be taught by an attending physician, advance practice registered nurse, or physician assistant.

The licensed healthcare professional who performs the training must verify that the proxy caregiver is proficient in the skills needed to care for the individual who has elected to receive care from a proxy. Such skills and knowledge typically include proper reading of prescription labels and abbreviations, understanding common classifications of medications, typical side effects, infection control procedures, and proper record-keeping.

The activities performed by a proxy caregiver must be carried out as part of written orders issued by an attending physician, advance practice registered nurse, or physician assistant. This plan of care must provideclear instructions for the proxy caregiver on what health maintenance activities may be performed, any specialized procedures to be performed, and what kinds of changes in the individual’s condition would require changes to the plan of care. The plan must also specify the frequency of training and evaluation requirements for proxy caregivers. It is expected that additional training will be providedwhen the individual’s plan of care changes (such as new medications or diagnoses), and the proxy caregiver is expectedto perform these additional duties for which she or he hadnot previously been trained.
